Terms of Use

1. This agreement

These Terms are the agreement between you and Jakub Nowacki SwiftIT, Ks. Kazimierza Ciuby 14, 43-600 Jaworzno, Poland, NIP 6322036596, REGON 527957448 ("Circa", "we", "us") for your use of the Circa mobile application and the service behind it.

By creating an account you accept these Terms. If you do not accept them, do not use Circa. How we handle your personal data is described in the Privacy Policy, which forms part of this agreement.

2. Who may use Circa

You must be at least 16 years old and able to enter a binding contract. You need a Google or Apple account to sign in. You are responsible for what happens under your account and for keeping your device secure.

3. What Circa is — and what it is not

Circa is not a medical device and gives no medical advice. It records what you tell it about your energy, focus and mood and shows you patterns in your own data. It does not diagnose, treat or prevent any condition, and it is not a substitute for a doctor, a therapist or any other qualified professional. If you have a health concern, talk to one.

The zones, insights and predictions Circa shows are estimates derived from your own entries, some of them generated by an AI model. They can be wrong. Treat them as a prompt to reflect, not as fact, and use your own judgement about your work and your health.

4. Your licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use Circa on devices you own or control, for your own non-commercial use, for as long as this agreement lasts.

Your check-ins, tags and profile answers remain yours. You give us only the permission we need to store them, process them and show them back to you, including sending them in de-identified form to our AI processor as described in the Privacy Policy. You confirm you have the right to give us the data you enter.

7. Availability and changes

We work to keep Circa running, but we do not promise it will be uninterrupted or error-free. We may change, suspend or discontinue features. If we discontinue a paid feature during a period you have paid for, you get a pro-rata refund of that period through the relevant app store, or a comparable replacement.

8. Ending the agreement

You can stop at any time by deleting your account in Settings. Deletion signs you out everywhere immediately and erases your data after 30 days, as described in the Privacy Policy. Your subscription must be cancelled separately in your app store account.

We may suspend or terminate your access if you break these Terms in a way that harms the service or other users, or where the law requires it. Where it is reasonable to do so, we tell you first.

9. Liability

Circa is provided as it is. To the extent the law allows, we exclude implied warranties and are not liable for indirect or consequential loss, lost profits, lost data beyond what our backups hold, or decisions you make based on what the app shows you.

Nothing here limits our liability for death or personal injury caused by our negligence, for intentional fault, or for anything else that cannot be limited under Polish law. Where our liability can be limited, it is capped at the amount you paid us in the 12 months before the event.

Your statutory rights as a consumer are unaffected by anything in these Terms.

10. Apple

Apple is not a party to this agreement and has no obligation to provide support for Circa. Apple is not responsible for the app or for any claim about it, including product liability, consumer protection or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce it against you. You confirm you are not located in a country subject to a US embargo or listed as a prohibited party, and that you will comply with applicable export law.

11. Governing law

Polish law applies. If you are a consumer, you keep the protection of the mandatory rules of the country where you live, and you may bring proceedings in the courts there.

12. Changes to these Terms

We may update these Terms. We publish the new version on this page and, for material changes, tell you in the app before they take effect. Continuing to use Circa after that means you accept the new version; if you do not, delete your account.
